Terms & Conditions
These Terms and Conditions ("Terms") govern your use of jaycee-barry.com and any products, programs, events, and content offered by Balanced Living Wellness, LLC ("we," "us," or "our"), including the free masterclass, the Deep Dive Questionnaire, BUILD, and SCALE (together, the "Services"). By using the Services, you agree to these Terms.
1. Not healthcare or professional advice
Our Services are business education and mentorship. They are not occupational therapy or any other healthcare service, and no provider-patient relationship is created. Nothing we provide is legal, tax, accounting, financial, or medical advice. Please consult a qualified professional for those needs. Any certification we issue reflects completion of our program only. It is not a professional license or credential, and it does not expand your scope of practice.
2. No guarantee of results
Any examples of income, results, or client outcomes are not typical and are not a promise or guarantee of what you will achieve. Your results depend on many factors, including your effort, experience, market, and circumstances. You are responsible for your own decisions and results.
3. Eligibility and accounts
You must be at least 18 years old to use the Services. You agree to give accurate information and to keep any login details private. You are responsible for activity under your account.
4. Purchases and payment
- Prices are listed in U.S. dollars and may change at any time before purchase.
- Payments are processed by third-party providers. Payment plans and financing are subject to the provider's terms and your enrollment agreement.
- If you choose a payment plan, you agree to make every payment on schedule. Missed payments may pause your access to the program.
5. Refunds
The Deep Dive Questionnaire and other digital products are delivered immediately when you buy them, so all sales are final and non-refundable. Refund terms for BUILD, SCALE, and other programs are set out in your enrollment agreement.
6. Programs and enrollment agreements
Enrollment in BUILD, SCALE, or any other program is also governed by a separate enrollment agreement. If that agreement conflicts with these Terms, the enrollment agreement controls for that program.
7. Calls, events, and the masterclass
Free masterclasses and calls are offered at our discretion and may be changed, rescheduled, or canceled. Live sessions may not be recorded unless we say so. Please do not record any session without our written permission.
8. Intellectual property
All content we provide, including videos, worksheets, the Deep Dive Questionnaire, templates, frameworks, and branding, is owned by Balanced Living Wellness, LLC or its licensors. You may use it for your own personal business use. You may not copy, resell, share, publish, or create competing products from it without our written permission.
9. Community conduct
Treat everyone in our community, calls, and events with respect. Keep other members' information confidential. We may remove anyone who harasses others, shares private content, or disrupts the community, without a refund.
10. Communications
By giving us your email or phone number, you agree that we may contact you about your purchase, calls, and our Services, as described in our Privacy Policy. You can opt out of marketing at any time.
11. Third-party services
The Services link to or rely on third-party tools, such as booking, payment, video, and community platforms. We are not responsible for their content, availability, or practices.
12. Disclaimer of warranties
The Services are provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law.
13. Limitation of liability
To the fullest extent permitted by law, Balanced Living Wellness, LLC and its owners, team, and contractors will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits or revenue, arising from your use of the Services. Our total liability for any claim will not exceed the amount you paid us for the Service that gave rise to the claim.
14. Indemnification
You agree to hold harmless and indemnify Balanced Living Wellness, LLC from claims arising from your use of the Services, your business, or your breach of these Terms.
15. Governing law
These Terms are governed by the laws of the State of New York. Any dispute will be resolved in the state or federal courts located in New York, and you agree to their jurisdiction.
16. Changes
We may update these Terms from time to time. Continuing to use the Services after an update means you accept the new Terms.
